OUTspoken Biography


June 11 – July 22, 2015

TO ENTER the OUTspoken Biography Contest (the “Contest”), simply visit the web page at each week during the Contest Period, and follow the instructions found on the site to vote for your favorite prominent LGBT Canadians from the list provided on the web page each week during the Contest Period. Each weekly vote you cast will provide one (1) entry into the draw for the Prize (“Entry”).

In the event of a dispute, entries received online shall be deemed to be submitted by the “Authorized Account Holder” of the email address submitted at the time of entry. “Authorized Account Holder” is defined as the natural person who is assigned to an e-mail address by an internet access provider, on-line service provider, or other organization (e.g. business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.

CONTEST PERIOD. The Contest starts at 9:00 p.m. Eastern Time (“ET”) on June 11, 2015 and closes on July 22, 2015 at 11:59 p.m. ET (the “Contest Period”) and there are six (6) Weekly Contest Periods during the Contest Period. Each Weekly Contest Period starts following the broadcast of the new episode of OUTspoken Biography (the “Series”) on OUTtv each Thursday during the Contest Period. Each Weekly Contest Period starts at 9:00 p.m. ET on Thursday and closes the following Wednesday at 11:59 p.m. ET. Entries received between 12:00 a.m. ET and 8:59 p.m. ET each Thursday during the Contest Period will not be eligible to be entered into the draw to win the Prize.

NUMBER OF ENTRIES Limit one (1) entry per natural legal person per Weekly Contest Period. Entrants may earn one (1) bonus entry into the prize draw by agreeing to subscribe to OUTtv’s email newsletter. Each entrant may obtain a maximum of seven (7) entries into the draw over the Contest Period. Illegible entries are ineligible. No purchase necessary. Void where prohibited.

CONTEST SPONSOR. The contest Sponsor is OUTtv Network Inc. (the “Contest Sponsor”).

GRANT OF RIGHT AND/OR LICENSE. By entering this Contest each entrant consents to the publication and/or use, in any medium, of the entrant’s entry, name, city of residence, photograph and/or image for publicity purposes carried out by the Contest Sponsor or its advertising and promotional agencies, without payment or compensation of any kind.

ELIGIBILITY. To enter and to be eligible to win, entrant must be legally resident in Canada, and be eighteen (18) years of age or older. Employees and their parents, siblings and children, and persons domiciled with an employee of the Contest Sponsor, its agents, parent, affiliated or related companies, subsidiaries, divisions, prize sponsors, and promotional and advertising agencies and administrators, are ineligible to enter.

PRIZE. There is one (1) Prize to be awarded. The Prize consists of one (1) iPhone 6 with an approximate retail value of Eight Hundred and Thirty-Nine Canadian Dollars (CAD$839.00).

WINNING.  All eligible Entries will be entered into a draw to be following the close of the Contest Period. The odds of winning a Prize will vary based on the number of eligible Entries received during the Contest Period. The draw will be held on July 23, 2015, and the winner will be announced on August 1, 2015 on the Contest Sponsor’s Facebook page and Twitter feed.

CLAIMING THE PRIZE.  In order to claim a Prize, the potential winner must first correctly answer, unaided, a time limited mathematical skill testing question administered by OUTtv. The Contest Sponsor, acting reasonably, will attempt to contact the prizewinner by email and/or telephone within two (2) business days after the close of the Contest Period. In the event the potential winner cannot be contacted within two (2) business days after the close of the Weekly Contest Period, they will be disqualified and an alternate potential winner will be selected. Proof of identification must be provided upon request. Before being awarded a Prize, the potential winners will be required to sign and return, within the time stipulated by the Contest Sponsor, a full release and indemnity form stating that he/she has read and understood these official rules and regulations (“Rules”), grants all consents required, authorizes the Contest Sponsor to broadcast, publish and disseminate his/her name, city of residence, photograph, likeness, sobriquet and/or voice, in connection with any promotion or publicity, and/or for general news, entertainment and information purposes at no additional compensation to the winner, beyond the awarding of the Prize, accepts the Prize as offered and releases the Contest Sponsor from any and all liability of any kind arising out of the Prize winner’s participation in this Contest and receipt and use of the Prize. In the event that a prizewinner does not comply with all the provisions as contemplated in these Rules, Contest Sponsor shall have the right to disqualify that prizewinner, and select an alternate prizewinner and the Contest Sponsor shall be fully and completely released and discharged from any liability or responsibility in this regard. The provisions and procedures referred to above relating to selection and notification of a potential winner, if applicable, shall be applied, with the necessary amendments, until a qualified winner has been duly selected.

ACCEPTANCE OF PRIZES. The Prize must be accepted as awarded. The Prize may not be sold, transferred and is not convertible to cash. The Contest Sponsor reserves the right to substitute the Prize in whole or in part in the event that all or any component of it is unavailable. Prizewinners are solely responsible for all costs not expressly described herein.

ACCEPTANCE OF RULES. By entering this Contest the entrants and participants automatically agree to accept and abide by these Rules. All decisions of the Contest Sponsor with respect to any aspect of this Contest, including without limitation the eligibility of entries, are final and binding on all entrants in all matters as they relate to this Contest.

The Contest Sponsor assumes no responsibility for garbled, lost, late, delayed, destroyed or misdirected entries, voice messages, e-mail or any computer errors or malfunctions. No correspondence will be entered into except with entrants requesting Rules by mail or requesting names of prizewinners (for which a self-addressed, postage paid envelope must be included). The Contest Sponsor does not assume any responsibility for incorrect or inaccurate capture of entry information, technical malfunctions, human or technical error, seeding or printing errors, lost, delayed or garbled data or transmissions, omission, interruption, deletion, defect or failures of any telephone or computer line or network, computer equipment, software or any combination thereof. Entry materials-data that have been tampered with or altered are void. If for any reason, in the opinion of the Contest Sponsor, in its sole discretion, the Contest is not capable of running as originally planned, or if the administration, security, fairness, integrity or the proper conduct of the Contest is corrupted or adversely affected, including by reason of infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond their control, the Contest Sponsor reserves the right to cancel, terminate, modify, amend, extend or suspend the Contest including canceling any method of entry, and at their discretion may elect to select a potential winner from previously received eligible entries. The Contest Sponsor reserves the right to modify the Rules without materially affecting the terms and conditions hereof.

The Contest Sponsor reserves the right in its sole discretion to disqualify any individual they find to be tampering with the entry process or the operation of the Contest or to be acting in violation of the Rules or otherwise in a disruptive manner. Any attempts to deliberately damage the Contest web site or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws and should such an attempt be made the Contest Sponsor reserves the right to seek remedies and damages to the fullest extent of the law. The Contest Sponsor shall not be held responsible for any errors or negligence that may arise or occur in connection with the Contest including any damage to an entrant’s computer equipment, system, software or any combination thereof, as a result of their participation in this Contest or from downloading any material from the Contest web site, where applicable.

Contest is subject to all applicable federal, provincial and municipal laws and regulations. Personal information collected from entrants will be used by Contest Sponsor for the purpose of administering this Contest and, if consent is given at the time of entry, to provide the entrants with marketing information relating to new and existing products and upcoming promotions. Entrants are able to opt in with respect to receiving such marketing information online. The Contest Sponsor will not sell, share or otherwise disclose personal information of entrants with third parties, other than to third parties engaged by them to fulfill the above purposes or as permitted or required by law.

By entering the Contest, entrants consent to the manner of collection, use and disclosure of personal information as set out in the Contest Sponsor’s Privacy Policy at Any inquiry concerning the personal information held by the Contest Sponsor should be addressed to OUTtv Network Inc. 53 East 6th Avenue, Vancouver, BC V5T 1J3.

In the event of any discrepancy or inconsistency between the terms and conditions of the Contest Rules and disclosures or other statements contained in any Contest related materials, including but not limited to the Contest entry form, or point of sale, television, print or online advertising, the terms and conditions of the Contest Rules shall prevail, govern and control.

In the Province of Quebec, any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses st des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.

All intellectual property, including but not limited to trade-marks, trade-names, logos, designs, promotional materials, web pages, source codes, drawings, illustrations, slogans and representations are owned by the Contest Sponsor and/or its affiliates or third-party licensors. All rights are reserved. Unauthorized copying or use of any copyrighted material or intellectual property without the express written consent of its owner is strictly prohibited.

This Contest shall be interpreted, construed and governed by the laws in force in the Province of British Columbia, Canada, without reference to its conflict of laws principles. Except where prohibited by applicable law, any controversy, claim or dispute arising out of this Contest will be referred to and finally settled (to the exclusion of the courts) by private and confidential binding arbitration before a single arbitrator held in Vancouver, British Columbia, Canada in English and governed by British Columbia law pursuant to the Arbitration Act of British Columbia.
